NY Daily News reports that a $10 million defamation lawsuit filed by a sleeping baseball fan was dismissed. The fan was caught on camera by ESPN sleeping through the fourth inning of a New York Yankees vs. Boston Red Sox game in April 2014. The sportscasters spent about 30 seconds commenting on the sleeping fan, Andrew Robert Recor. Rector's suit alleged defamatory comments; however, Judge Julia Rodriguez (no relation) ruled that the broadcasters wondering aloud how Rector could have fallen asleep so early in the contest, how much his neck might hurt the next day, and why a man sitting nearby didn’t wake him up was within their rights and could not be considered false statements.
I'm more concerned about Rector.
